Travis County District Attorney Ronald Earle today released the following statement:

The April Term of the 147th District Court Grand Jury today issued a no bill in the investigation of Austin Police Officer Michael Olsen in the June 3rd, 2007 shooting death of Kevin Brown.

The term of the Grand Jury was extended in order to complete the investigation of this matter. The Grand Jury heard 10 days of evidence and testimony beginning in late June. The members heard from 12 witnesses, including 7 civilian witnesses, 4 expert or law enforcement witnesses and Officer Olsen.

Under the law, the question of fact before the Grand Jury was whether the officer was reasonable in believing that deadly force was immediately necessary to protect himself against the use or attempted use of deadly force.

Press packets containing details of the investigation, including police reports and witness statements, will be available at the District Attorney’s Office, on the first floor of the Criminal Justice Center at 11:00 a.m. on Thursday, August 9, 2007.
